Terms & Conditions

USER AGREEMENT

THE FOLLOWING DESCRIBES THE TERMS ON WHICH THE CORPORATION OF THE COUNTY OF SIMCOE OFFERS YOU ACCESS TO OUR AUCTION SITE.

This agreement describes the terms and conditions applicable to your use of this auction site. If you do not agree to be bound by the terms and conditions contained in this agreement you cannot use this site.

 

User verification

To register as a user of this site you must read, agree with and accept all of the terms and conditions contained in this agreement. The County of Simcoe may amend this agreement at anytime by posting the amended terms on this site. All amended terms shall become effective twenty-four (24) hours after they are initially posted. This agreement is effective upon registration.

 

Eligibility

This auction site is available only to and may only be used by individuals who can form legally binding contracts under applicable law. Persons under the age of eighteen (18) are strictly prohibited from bidding on any item on this site. Photo identification may be required prior to completion of the sale.

 

Fees

Registering on this site and bidding on items is free of charge.

 

Registration

Users are required to register with this site prior to submitting a bid. Registrations.

 

Bidding & Buying

If a buyer has not bid within twelve months of Registration or their most current bid, their account may be deleted and the buyer may have to register again if they wish to bid on an item. Bidders will normally be notified if they are out bid by email notification, however, if there is a disruption in service, the County of Simcoe does not guarantee continuous, uninterrupted access to our service. It is imperative that bidders be vigilant of their bids and monitor the website for active bidding to see if they have been outbid.

Items will be sold to the highest bidder at the time the auction closes. As a buyer you are obligated to complete the transaction with the County if you are the highest bidder at the end of the auction. In the event that you fail to complete the purchase you will be prohibited from bidding on future items.

 

All bid amounts are shown in Canadian funds.

 

Items will be displayed for a minimum of five (5) business days, opening and closing dates shall be displayed on the site.

 

Available Items

As items become available they will be posted on the site. Each item will be accompanied with a photo, description and current location of the item. Details will also include the posting date, date that the auction will close and last bid price.

 

Failed Transactions

In the event that a transaction is not completed by the highest bidder the item shall be offered to the second highest bidder. If the second highest bidder is uninterested in the item, the subsequent bidders will be offered the item based on their bid. The item may be placed on the auction site as a new posting.

 

Time is of the Essence

Upon notification of your bid being the successful bid you shall have forty-eight (48) hours to submit payment to the County of Simcoe. Bidders who fail to make payment within this timeline shall be removed from the list of registered users and prohibited from placing future bids. The item shall be returned to the auction site as a new posting.

 

Payment

Payment must be made by debit card within forty-eight (48) hours of notification by County staff. Payment must be made at the County of Simcoe Administration Building, Purchasing, Fleet & Property Division located at 1110 Highway 26 West, Midhurst, Ontario, L9X 1N6.

 

Warranty & Condition

Items are sold on an “as is, where is” condition with no warranty. The successful bidder accepts the condition of the item at the time of sale.

The Corporation of the County of Simcoe shall not be liable for costs to repair items sold.

 

Returns

Items cannot be returned.

 

Delivery

It is the responsibility of the successful bidder to arrange pick up of the item(s), load and remove the item(s) from the County facility indicated. Pick-up of goods shall only be permitted during normal working hours as arranged by County staff and must be completed within two (2) business days of notification of successful bid. Any damage to County property caused by the removal of these items will be charged to the purchaser.

 

Inspection

Items posted on the auction site are not available for inspection unless indicated.

 

Reserves

The County of Simcoe reserves the right to impose a reserve on any item and shall do so by placing the initial bid amount at the start of the auction.

 

Fraud

The County of Simcoe reserves the right to suspend or terminate your account if you are found to have engaged in fraudulent activity in connection with this site.

 

User Information

Your information is defined as any information you provide to the County of Simcoe in the registration or bidding process. Your information shall be used solely for the purpose of completion the sale.

 

Location

Items available for sale may be located at various facilities throughout Simcoe County. The location of each item will be posted on the site.

 

Indemnity

You agree to indemnify and hold the Corporation of the County of Simcoe, officers, directors, agents and employees harmless from any claim or demand including reasonable attorney fees made by any third party due to or arising out of your breach of this agreement or your violation of any law or the rights of a third party.

 

Interruption of Service

We do not guarantee continuous, uninterrupted or secure access to our service. Auctions that are interrupted by power outages, internet disruptions etc.... may be extended to allow users additional time to submit their bids.

 

General

This agreement shall be governed in all respects by the laws of the Province of Ontario.
